Article 1: Purpose

This agreement aims to establish the terms and conditions governing the rights, responsibilities, and procedures for users and CJ Korean Cosmetics Global Corporation (referred to as "the Company") concerning the registration and use of the online store known as Korean Cosmetics Global Mall.

Article 2: Definitions

For the purpose of this agreement, the following definitions shall apply:

  1. "Korean Cosmetics Global Mall" refers to the virtual platform operated by the Company, enabling users to engage in the purchase and sale of goods and services.
  2. "Services" encompass all online and related services provided by the Company through Korean Cosmetics Global Mall.
  3. "User" refers to both registered customers and guests who utilize the services offered by the Company.
  4. "Registered Customer" denotes an individual who has agreed to this agreement and completed the registration process on Korean Cosmetics Global Mall.
  5. "Guest" refers to a person who uses the services on Korean Cosmetics Global Mall without registering.
  6. "ID" represents the user's provided email address, serving as an identifier for customer identification purposes.
  7. "Password" refers to a unique combination of letters and numbers created by the user to verify their identity and protect their rights.
  8. "Application (App)" indicates the software programs provided by the Company, allowing users to purchase goods and access services on Korean Cosmetics Global Mall.
  9. "Reward Points" denote a form of payment method provided by the Company, which can be accumulated and utilized by users following the purchase of goods or services.

Article 3: Statement and Modification of Terms

  1. The Company shall prominently display the contents of this agreement, including the store name, representative, address, business registration number, and contact information (phone number, email address, etc.) on the initial homepage of Korean Cosmetics Global Mall. The detailed agreement may be accessible through a separate link.
  2. User registration implies the user's consent to this agreement, and it becomes effective upon completion of the registration process.
  3. The Company reserves the right to modify this agreement in accordance with applicable laws, including but not limited to the Act on Consumer Protection in Electronic Commerce, Regulation of Adhesion Contract Act, and other relevant statutes.
  4. In the event of any modifications to this agreement, the Company shall announce the effective date and reasons for the change on the initial page of Korean Cosmetics Global Mall. Registered customers will also receive notification via email. If the modifications are unfavorable to registered customers, the announcement shall be made 30 days in advance. The Company will ensure that the modified content is presented clearly for the understanding of registered customers.
  5. Users are deemed to have consented to the modifications if they do not raise any objections within the specified dispute time period stated in the announcement. However, if the announcement indicates that failure to object will result in disadvantages for the user, their consent will not be assumed.

Article 4: Provision and Modification of Services

  1. The Company shall provide services in accordance with the terms and conditions set forth in this agreement and shall exert its best efforts to ensure stable and continuous service provision.
  2. The Company may modify, suspend, or terminate the provision of services in the following cases: a. Scheduled maintenance, repairs, or replacement of facilities related to the service provision b. Failure or disruption of services due to unforeseen circumstances, such as natural disasters, emergencies, or technical difficulties c. Suspension or termination of services as deemed necessary by the Company for operational or managerial reasons d. Changes in the overall service policy of the Company
  3. The Company shall notify users in advance of any modifications, suspensions, or terminations, except in cases of emergency or unavoidable circumstances. Notifications may be made through Korean Cosmetics Global Mall's website, email, or other appropriate means.

Article 5: User Registration

  1. Users who wish to register on Korean Cosmetics Global Mall must provide accurate and complete information as requested by the registration form.
  2. Users are responsible for maintaining the confidentiality of their ID and password. They shall be solely responsible for all activities conducted under their ID.
  3. Users must immediately notify the Company in case of any unauthorized use or breach of their ID or password.
  4. The Company may refuse or terminate user registration in the following circumstances: a. False, inaccurate, or incomplete information provided during registration b. Previous violation of this agreement leading to termination of user registration c. Other justifiable reasons as determined by the Company

Article 6: Protection of Personal Information

The Company shall handle user information in accordance with its privacy policy. Users' personal information shall be protected and used solely for the purpose of providing services, unless otherwise agreed by the user or required by applicable laws and regulations.

Article 7: Obligations of Users

  1. Users shall comply with this agreement and all applicable laws and regulations while using Korean Cosmetics Global Mall.
  2. Users shall not engage in any of the following activities: a. Falsifying information, including personal identification information, or using another person's information without proper authorization b. Unauthorized use, reproduction, distribution, or modification of the content provided by the Company c. Disrupting the normal operation of services or infringing upon the rights of the Company or other users d. Posting, transmitting, or disseminating obscene, defamatory, or illegal materials e. Unauthorized commercial activities or any form of spamming or advertising
  3. Users shall be liable for any damages incurred by the Company or other users due to their violation of this agreement or any unlawful activities committed while using Korean Cosmetics Global Mall.

Article 8: Termination of User Registration and Use Restriction

  1. Users may request termination of their registration at any time, and the Company shall promptly process such requests.
  2. The Company may restrict or terminate user registration and use of services in the following cases: a. Violation of this agreement b. Provision of false, inaccurate, or incomplete information during registration c. Unauthorized use of another user's ID or fraudulent activities d. Conduct that disrupts the normal operation of services or infringes upon the rights of the Company or other users e. Other justifiable reasons as determined by the Company
  3. In the event of termination or restriction of user registration, the Company may delete all related data and information, and the user shall have no claim or right to access such data or information.

Article 9: Suspension of Services

  1. The Company may temporarily suspend or restrict services in the following cases: a. Regular or emergency system maintenance or repairs b. Technical difficulties or disruptions beyond the Company's control c. Natural disasters, acts of God, or other unforeseen circumstances d. Other justifiable reasons as determined by the Company
  2. The Company shall make reasonable efforts to notify users in advance regarding the suspension or restriction of services, except in cases of emergency or when immediate action is necessary.

Article 10: Intellectual Property Rights

  1. All intellectual property rights related to Korean Cosmetics Global Mall, including but not limited to trademarks, logos, software, content, and designs, are owned by the Company or its licensors.
  2. Users shall not use, reproduce, distribute, or modify any intellectual property of the Company without prior written consent.
  3. Users may submit reviews, feedback, or suggestions to the Company regarding the services. By doing so, users grant the Company a non-exclusive, worldwide, royalty-free, and transferable right to use, reproduce, modify, adapt, publish, and display such submissions for any purpose without any obligation to compensate the user.

Article 11: Limitation of Liability

  1. The Company shall not be liable for any damages or losses incurred by users in connection with the use of Korean Cosmetics Global Mall, except in cases of willful misconduct or gross negligence by the Company.
  2. The Company shall not be responsible for any damages or losses resulting from interruptions, delays, or errors in the services caused by factors beyond its reasonable control, including but not limited to internet or telecommunications failures, server malfunctions, or computer viruses.
  3. The Company shall not be liable for any damages or losses resulting from the use of third-party websites or services linked to Korean Cosmetics Global Mall.

Article 12: Governing Law and Jurisdiction

  1. This agreement shall be governed by and construed in accordance with the laws of the Republic of Korea.
  2. Any disputes arising from or in connection with this agreement shall be submitted to the exclusive jurisdiction of the competent courts in the district where the Company's headquarters are located.

Article 13: Miscellaneous

  1. This agreement constitutes the entire agreement between the user and the Company regarding the use of Korean Cosmetics Global Mall and supersedes any prior agreements or understandings, whether written or oral.
  2. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  3. The Company's failure to exercise or enforce any right or provision of this agreement shall not constitute a waiver of such right or provision.

Article 14: Assignment

  1. Users may not assign or transfer their rights or obligations under this agreement to any third party without the prior written consent of the Company.
  2. The Company may assign or transfer its rights and obligations under this agreement to any third party without the consent of users, provided that such assignment or transfer does not adversely affect the rights of users.

Article 15: Entire Agreement

  1. This agreement, including all its sections and any additional terms or policies referenced herein, constitutes the entire agreement between the user and the Company regarding the use of Korean Cosmetics Global Mall.
  2. Any prior agreements, understandings, or negotiations, whether written or oral, are superseded by this agreement.

Article 16: Modifications

  1. The Company reserves the right to modify or revise any provisions of this agreement at any time, without prior notice.
  2. Users are responsible for regularly reviewing the agreement and should periodically check for any updates or changes.
  3. Continued use of Korean Cosmetics Global Mall after any modifications or revisions shall constitute acceptance of the modified agreement.

Article 17: Language

  1. This agreement is originally written in the Korean language.
  2. In the event of any discrepancy between the Korean version and any translation of this agreement, the Korean version shall prevail.

  1. For any inquiries, questions, or concerns regarding this agreement or the services provided by Korean Cosmetics Global Mall, users may contact the Company at the following:

Article 19: Interpretation

  1. The headings and titles of the sections in this agreement are provided for convenience only and shall not affect the interpretation or construction of any provision.
  2. The singular includes the plural, and vice versa. Words denoting any gender include all genders.
  3. References to "including" or "includes" shall be deemed to mean "including, without limitation."
  4. References to statutes, laws, or regulations shall include any amendments or replacements thereof.

Article 20: Electronic Communications

  1. By using Korean Cosmetics Global Mall, users consent to receive communications from the Company electronically.
  2. Electronic communications may include notices, updates, newsletters, promotional materials, or other information relating to the services.
  3. Users agree that all agreements, notices, disclosures, or other communications provided electronically satisfy any legal requirements that such communications be in writing.

Article 21 (International Shipping Services)

Section 1: The Company's Provision of International Shipping Services The Company facilitates international shipping services for goods under a sales contract through its established international shipping network and business relationships.

Section 2: Changing Delivery Information 2.1 If the User wishes to modify delivery information such as the delivery address or contact details, it can be directly updated only when the order status is 'Payment completed.' However, once the order status progresses to 'Preparing Shipment,' any changes to the delivery information must be made through the CS center. Please note that due to time differences, immediate CS response may not be possible. Certain payment methods may also restrict changes to delivery information.

Section 3: Customs Duties and Taxes 3.1 The recipient of the international shipment is responsible for any customs duties and taxes imposed by the destination country as a result of the shipping process.

Section 4: Customs Processing and Delivery Delays 4.1 International shipments undergo customs processing upon arrival in the destination country. Users should acknowledge that this process can sometimes cause delays in the expected delivery date.

Section 5: Returns for International Shipments 5.1 Once the Company approves the reason for return, which requires the submission of evidence such as product defects, the User must contact the international shipping customer service center. 5.2 The User should arrange for the return of the product through a local overseas shipping courier and provide documentation to the Company as proof of the return shipping costs.

Section 6: Shipment Refusal and Associated Costs 6.1 If the recipient refuses to accept the shipment, the User bears responsibility for the initial shipping fees and any additional costs incurred during the return shipment. These costs will be deducted from the refund.

Article 22 (Refunds, Returns, Exchanges)

Section 1: Unavailability of Goods and Refunds 1.1 If the Company is unable to provide the Goods due to reasons such as insufficient stock, it will promptly notify the User. Within three business days of payment, the Company will issue a refund or take appropriate refund measures.

Section 2: Order Cancellation 2.1 The User can request cancellation of an order (purchase contract) only when the order status is 'Payment completed' by submitting a cancellation request. However, even if the order status appears as 'Payment completed' on the homepage, the Company reserves the right to reject or withhold the User's cancellation request if the delivery process has already commenced or if there are special circumstances such as scheduled or created order production. In such cases, the User will receive separate notification regarding the cancellation request (including site notifications).

Section 3: Cancellation, Return, and Exchange Limitations for International Shipments 3.1 Once the order status progresses to "Preparing Shipment," it is considered that international shipping has begun, and as a result, the order (purchase contract) cannot be canceled, returned, or exchanged. However, after the completion of international shipping, the Company may consider approving the User's request for return or exchange.

Section 4: Approval for Return 4.1 To obtain approval for a return from the Company, the User must submit objective evidence to prove the reason for the return, such as product defects. Once defects are verified, the Company will assume responsibility for all shipping costs associated with the return and reshipment.

Section 5: Cancellation of Orders with Insufficient Information 5.1 Even after the order is completed, if the delivery information is deemed insufficient or if normal transactions are deemed unfeasible, the Company reserves the right to cancel the order (purchase contract) at its discretion. In such cases, the Company will refund the payment or initiate the necessary refund procedures.

Section 6: Partial Cancellation or Return of Orders 6.1 In the case of partial cancellation or return of an order, the refund amount may slightly differ from the original payment due to changes in the discount policy conditions.

Article 21 (Right to Terminate)

Section 1: Order Cancellation Request 1.1 A User who has established a purchase contract for Goods with the Company can request to cancel the order within seven days of the contract's effective date. If the Goods are delivered after the effective date, the cancellation request period considers the delivery date or the start of delivery. However, if the Act on the Consumer Protection in Electronic Commerce or other relevant regulations specify different cancellation periods, those regulations will apply. If the Company sets a different cancellation period and notifies the User in advance, the User may cancel the order within the specified period.

Section 2: Non-eligible Items for Return or Exchange 2.1 The User may not request a return or exchange for items falling under the following conditions:

  1. The item is destroyed or damaged due to the User's responsibility, excluding damage to packaging necessary for inspection.
  2. The item's value significantly decreases due to the User's full or partial consumption.
  3. The item's value significantly decreases due to the passage of time, making it unsuitable for resale.
  4. The item's original packaging is damaged, and it can be reproduced into an item of the same quality.
  5. Services or digital contents specified under Article 2, Section 5 of the Framework Act on the Promotion of Culture Industries, except for divisible services or divisible digital contents not specified.
  6. The Company has notified the User in advance about cancellation restrictions due to foreseeable and irrevocable damages resulting from cancellation and has obtained the User's consent.

Section 3: Non-Effectiveness of Cancellation Restrictions 3.1 If the Company has not clearly notified the cancellation restrictions or taken appropriate measures such as providing information on product usage, the restrictions will not be enforced.

Section 4: Damaged Goods or Non-Executed Purchase Contracts 4.1 Regardless of Sections 1 and 2, if the received Goods differ from what was indicated or advertised, or if the purchase contract is not executed accordingly, the User may cancel the order within three months of delivery or within 30 days of discovering or potentially discovering the discrepancy.

Article 23 (Termination Effects)

  1. The Company must take appropriate actions to issue a refund within three business days upon receiving returned goods. If there is a delay in the refund, the Company is required to pay a delay interest rate as stipulated in Article 21 of the Enforcement Decree of the Act on the Consumer Protection in Electronic Commerce, etc.

  2. In the case of refunds, if the User made the payment using a credit card or other methods determined by law, the Company will promptly contact the relevant payment processor to request the suspension or cancellation of billing.

  3. When canceling orders, the User is responsible for the fees associated with returning the item. The Company will not impose damages or penalty charges for order cancellations. However, if the received Goods or other items differ from the indicated or advertised ones, or if the purchase contract is not fulfilled as agreed, the Company will bear all return costs.

  4. If the item has been partially used or consumed, the Company may, within legal limits, demand from the User the profits gained from its use or the costs incurred in providing the item.

  5. In order to cancel a purchase, any Reward Points issued from the purchase must be returned.

  6. If the User has paid shipping fees during the initial delivery, the Company will clearly specify who is responsible for the costs in case of cancellation.

Article 24 (Operation of Reward Points and Other Systems)

  1. The Company may grant Reward Points to Users who purchase Goods or use specific payment methods, according to Korean Cosmetics Global Global Mall Reward Point operation policies. These policies will be separately notified and subject to change based on Company circumstances.

  2. Reward Points can be utilized as a form of payment to purchase goods from Korean Cosmetics Global Mall. Points cannot be redeemed for cash, except for certain exceptions such as gift certificates or gift cards, and can be used starting from 1 point.

  3. Reward Points expire under the following circumstances:

    • Registered Customers closing their accounts.
    • Expiration date has passed or the conditions for expiration have been met.
    • Two years have elapsed from the date of issuance (excluding Reward Points issued before April 29, 2021, which expire on April 28th, 2023).
  4. The Company reserves the right to forfeit or suspend Reward Points used for unlawful profit or malicious transactions.

Article 25 (Relationship Between "Mall" and "Linked Mall")

  1. When an online store is connected to another online store through hyperlinks (including text, images, video, etc.), the former is referred to as the "Mall" (website), and the latter as the "Linked Mall" (website).

  2. The "Mall" is not responsible for the goods provided by the "Linked Mall" or for transactions conducted between the "Linked Mall" and the User, provided that a disclaimer is disclosed on the initial page of the "Linked Mall" or as a pop-up window when the hyperlink is clicked.

Article 26 (Damages)

Any party responsible for violating this Agreement or relevant laws is obliged to indemnify the damaged party for any resulting damages.

Article 27 (Exemption of Liability)

  1. The Company shall not be held liable for damages for which the User is responsible.

  2. Regarding information, data, or facts posted by a User or third party, the Company does not guarantee the completeness, safety, appropriateness, or legitimacy (no violation of third-party rights) of such information. Furthermore, the Company is not responsible for the intentions of the User or third parties to transact.

  3. The Company is not liable for damages arising from the inability to provide services due to force majeure, such as natural disasters.

  4. If the Company provides services in partnership with an affiliate website, the Company is not held liable for any damages arising from the services provided by the affiliate website.

Article 28 (Applicable Laws and Jurisdiction for Disputes)

  1. This Agreement and the Services shall be governed, construed, and performed in accordance with the laws of the Republic of Korea.

  2. Both the Company and the User are obligated to make every effort to amicably settle disputes arising in relation to the Services.

  3. Any dispute arising between the Company and the User in connection with the Agreement or Services shall be resolved in accordance with the procedures set out in the Civil Procedure Act of the Republic of Korea.
